Int'l Trade Comm'n, 474 F.3d 1281 (2007) In an appeal from a final determination concerning civil penalties for violation of a cease and desist order which barred defendant from importing disposable cameras that infringed certain Fuji's patents, the court finds that: 1) Fuji lacked standing to bring its appeal; and 2) the cease and desist order and the findings of the International Trade Commission were proper, with the exception of a ruling that cameras in which full backs were replaced were impermissibly reconstructed. The matter is thus remanded to the Commission for a recalculation of the appropriate civil penalty for defendant.

US, 458 F.3d 1345 (2006) A decision of the U.S. Court of International Trade instructing the U.S. International Trade Commission to issue a determination that the domestic industry was not materially injured by less-than-fair-value imports of certain steel sheets from Japan is reversed where the trade court erred in assessing credibility and in reweighing the evidence before the commission, and erred in concluding that the commission's finding of material injury to the domestic injury was not supported by substantial evidence.
